Terms of Use

1. Definitions

  • "Service" refers to our IBAN validation API service
  • "API" refers to our IBAN validation application programming interface
  • "You" refers to the individual or entity using our Service
  • "We", "Our", "Us" refers to SecureIban
  • "Stripe" refers to our payment processor Stripe, Inc.

2. Service Description

The Service provides IBAN (International Bank Account Number) validation through an API, including:

  • IBAN structure validation
  • Country-specific rule validation
  • Bank information retrieval
  • SEPA capabilities verification

3. Disclaimer and Limitation of Liability

3.1 Validation Disclaimer

While our Service employs standardized validation methods, YOU EXPRESSLY UNDERSTAND AND AGREE that:

a) Our validations are PURELY TECHNICAL and include:

  • IBAN structure verification
  • Checksum validation
  • Country code verification
  • Bank code validation
  • Specific country rules application

b) A "valid" result from our API does NOT guarantee:

  • The actual existence of the bank account
  • The ownership of the account
  • The ability to perform transactions
  • The solvency of the account holder or the bank
  • The current status of the account (it may be closed, frozen, or restricted)

3.2 Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR:

a) Any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:

  • The use or inability to use our Service
  • Any validated or invalidated IBAN
  • Decisions made based on our API results
  • Financial transactions performed using validated IBANs
  • Errors in validation results

b) The maximum liability, if any, is strictly limited to:

  • The amount paid by you for the Service in the last 12 months
  • In case of free tier usage, no compensation will be provided

4. Service Usage and API Calls

4.1 Plans and Limitations

  • Your API usage is governed by your subscription plan
  • Usage limits are specified in your subscription details
  • We reserve the right to adjust these limits with notice
  • Usage monitoring is available through your dashboard

4.2 API Key Usage

  • API keys are strictly confidential
  • You are responsible for maintaining their security
  • Any usage through your API key is your responsibility
  • Sharing or reselling API keys is strictly prohibited

5. Payment Terms

5.1 Billing

  • All payments are processed through Stripe
  • Prices are displayed excluding VAT/taxes
  • Billing is done in advance for subscription plans

5.2 Refunds

  • No refunds for unused API calls
  • Service interruption refunds are at our discretion
  • Disputed charges must be reported within 30 days

6. Data Usage and Privacy

6.1 Data Processing

  • We do not store validated IBANs
  • Bank information is updated regularly but may not reflect real-time changes
  • We comply with GDPR and similar data protection regulations

6.2 Data Accuracy

  • Bank data is updated periodically
  • SEPA capabilities may change without notice
  • Country-specific rules are maintained regularly but may have delays in updates

7. Modifications

We reserve the right to:

  • Modify these terms at any time
  • Change API functionality with notice
  • Update validation rules as banking standards evolve
  • Modify pricing with 30 days notice

8. Term and Termination

We may terminate or suspend your access if:

  • You violate these Terms
  • You exceed API call limits repeatedly
  • You attempt to circumvent technical limitations
  • You engage in abusive or fraudulent behavior

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
